1. Acceptance of Terms

Welcome to UPPF Studio Houston ("we," "our," or "us"). By accessing our website at uppfstudio.com (the "Site") or using our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Site or services.

These Terms apply to all visitors, users, and others who access or use our services, including but not limited to paint protection film installation, color PPF application, window tinting, and related automotive protection services in Houston, Texas.

2. Services Description

UPPF Studio Houston provides professional automotive protection services including:

• Paint Protection Film (PPF) installation - clear and color options
• Window tinting services
• Ceramic coating applications
• Paint correction services
• Custom vehicle protection solutions

All services are performed by trained technicians using premium materials from authorized manufacturers including Hammerhead Clear Films, Cobia Color Films, and Manta Films.

3. Appointments and Scheduling

Booking: Appointments can be scheduled through our website, phone, or in person. All appointments are subject to availability and confirmation.

Cancellation Policy: We require at least 48 hours notice for appointment cancellations or rescheduling. Cancellations made with less than 48 hours notice may be subject to a cancellation fee of up to 50% of the service cost.

No-Show Policy: Failure to appear for a scheduled appointment without prior notice may result in a no-show fee equal to 50% of the scheduled service cost and may affect future booking privileges.

4. Pricing and Payment

Quotes: All service quotes are estimates based on the information provided. Final pricing may vary based on actual vehicle condition, size, and complexity of installation.

Payment Terms: A deposit of 50% may be required to secure your appointment. Full payment is due upon completion of services unless other arrangements have been made in writing.

Accepted Payment Methods: We accept cash, credit cards, debit cards, and approved financing options. All prices are in U.S. dollars.

Price Changes: We reserve the right to modify our pricing at any time. Price changes will not affect services already scheduled or in progress.

5. Vehicle Condition and Preparation

Pre-Service Inspection: All vehicles will be inspected before service begins. Any pre-existing damage, scratches, or paint defects will be documented.

Vehicle Cleanliness: Vehicles should be reasonably clean upon arrival. Excessively dirty vehicles may require additional cleaning at an extra charge.

Paint Condition: PPF installation requires paint to be in good condition. Paint correction services may be recommended or required before PPF installation, which will incur additional costs.

6. Warranties and Guarantees

Manufacturer Warranties: Paint protection films come with manufacturer warranties against yellowing, cracking, peeling, and hazing. Warranty terms vary by product and are provided in writing at the time of service.

Installation Warranty: We warrant our installation workmanship for a period specified in your service agreement. This warranty covers defects in installation but does not cover damage from accidents, improper care, or normal wear and tear.

Warranty Exclusions: Warranties do not cover:

• Damage from accidents, collisions, or impacts
• Damage from improper washing or maintenance
• Damage from chemical exposure or environmental contaminants
• Modifications or repairs performed by unauthorized parties
• Normal wear and tear or cosmetic changes over time
• Pre-existing paint defects or damage

7. Limitation of Liability

To the maximum extent permitted by law, UPPF Studio Houston shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use our services
• Any unauthorized access to or use of your vehicle
• Any interruption or cessation of services
• Any bugs, viruses, or other harmful code transmitted through our Site
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted or transmitted through our services

Our total liability for any claims under these Terms shall not exceed the amount paid by you for the specific service giving rise to the claim.

8. Vehicle Storage and Liability

Storage: While your vehicle is in our care, it will be stored in our climate-controlled facility. We take reasonable precautions to protect your vehicle but are not responsible for theft, vandalism, or acts of God.

Personal Property: We are not responsible for any personal property left in vehicles. Please remove all valuables before dropping off your vehicle.

Extended Storage: Vehicles not picked up within 7 days of service completion may be subject to daily storage fees. Vehicles not claimed within 30 days may be subject to lien procedures under Texas law.

9. Intellectual Property

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by UPPF Studio Houston, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site without our prior written consent.

10. Photography and Marketing

By using our services, you grant UPPF Studio Houston permission to photograph your vehicle and use such photographs for marketing, advertising, and promotional purposes on our website, social media, and other marketing materials. If you do not wish your vehicle to be photographed or used for marketing purposes, please notify us in writing before service begins.

11. Indemnification

You agree to defend, indemnify, and hold harmless UPPF Studio Houston, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site or services.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Harris County, Texas, and you hereby consent to personal jurisdiction and venue therein.

13. Dispute Resolution

Informal Resolution: If you have any dispute with us, you agree to first contact us at contact@uppfstudio.com and attempt to resolve the dispute informally.

Arbitration: If we cannot resolve a dispute informally, any dispute arising out of or relating to these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Houston, Texas.

Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually. You agree to waive any right to have any dispute brought, heard, or arbitrated as a class action or in any other proceeding in which either party acts or proposes to act in a representative capacity.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired, and such provision shall be deemed modified to the minimum extent necessary to make such provision valid, legal, and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy and any service agreements you sign, constitute the entire agreement between you and UPPF Studio Houston regarding the use of our Site and services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of our Site or services after any such changes constitutes your acceptance of the new Terms.
